These Terms of Use ("Terms") are an agreement between you and Hueku ("we," "us," or "our") governing your use of the Hueku mobile application and related content (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, please don't use the App.
01License to use Hueku
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial enjoyment, in accordance with these Terms and the rules of the app store you downloaded it from.
02Things not to do
To keep Hueku calm and fair for everyone, you agree not to:
- Copy, modify, reverse-engineer, decompile, or attempt to extract the source code or puzzle data of the App, except where the law expressly permits it.
- Rent, sell, sublicense, or redistribute the App or its content.
- Use cheats, automation, bots, or exploits, or tamper with in-app purchases, coins, streaks, or ad rewards.
- Use the App in any unlawful way or in any way that disrupts or harms the service or other users.
03Your content & sharing
When you complete a puzzle, you can share the solved picture using your device's share features. The puzzle artwork and clues are our content (see Section 6); you're responsible for how and where you choose to share images generated by the App.
04Virtual items & purchases
- Hueku is free to download. It offers optional in-app purchases, including a one-time Remove Ads and consumable coin packs, and may include rewarded ads that grant in-game items.
- Coins and other virtual items have no real-world monetary value, cannot be exchanged for cash, and are licensed to you, not sold.
- All payments are processed by Apple or Google. Purchases, billing, and refunds are subject to the terms of the applicable app store.
- We may modify, manage, or discontinue virtual items or pricing at any time, to the extent permitted by law.
05Advertising
Unless you purchase Remove Ads, the App may display advertising from third parties. Your interactions with ads, and any sites or offers they link to, are between you and the advertiser. Ad and tracking choices are described in our Privacy Policy.
06Intellectual property
The App and all of its content — including the name "Hueku," the character "Mochi," the puzzle artwork, clue designs, code, graphics, audio, and look and feel — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.
07Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we handle information. By using the App, you acknowledge that policy.
08Updates & availability
We may release updates, add or remove puzzles and features, or discontinue the App or any part of it at any time. We don't guarantee the App will always be available, uninterrupted, or error-free.
09Disclaimers
10Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of (or inability to use) the App. Where liability cannot be excluded, it is limited to the amount you paid us for the App in the twelve months before the claim, or USD $10, whichever is greater.
11Apple & Google app store terms
If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its support; Apple is, however, a third-party beneficiary entitled to enforce these Terms. Similar terms apply for the Google Play Store. Your use must also comply with the applicable app store's terms of service.
12Termination
These Terms apply until terminated. You may end them by deleting the App. We may suspend or end your access if you breach these Terms. Sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will survive termination.
13Governing law
These Terms are governed by the laws applicable in your place of residence to the extent required by mandatory consumer-protection law; otherwise, by general principles of contract. Nothing here limits any statutory rights you have as a consumer that cannot be waived.
14Changes to these Terms
We may update these Terms from time to time. We'll revise the "Last updated" date above and, for material changes, provide notice within the App. Continuing to use Hueku after changes take effect means you accept the updated Terms.
